29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) At the Vidalia Valley LLC 4320 Hwy 178, Lyons, GA 30436 in Peeler Room 1, Peeler Room 2, and the Hygiene Room, on or about August 25, 2022, and at times prior to, Vidalia Valley, LLC, the creating and correcting employer, exposed employees to noise hazards in that a hearing conservation program was not implemented for an employee exposed to noise at 247.9% of the action level (8-hour time-weighted average sound level of 90 dBA) or an equivalent sound level of 96.55 dBA during the 525 minute sampling period.

29 CFR 1910.134(c)(2)(i):Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: a) At 4320 GA Hwy 178, Lyons, GA 30436: on or about August 22, 2022, and at times prior to, Vidalia Valley, LLC, the creating and correcting employer exposed employees to respiratory hazards in that the Appendix D to 29 CFR 1910.134 was not provided to employees voluntarily wearing N95 masks.
