OSH ACT of 1970 Section (5)(a)(1):OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a drowning hazard:   (a) On or about August 19, 2022, at jobsite located at 9910 99th Avenue in Kenosha, Wisconsin, employees using a zero turn lawnmower eXmark  Lazer Z E-Series 52" riding lawnmower, to cut the lawn on inclines of approximately 15 degrees, and closer than two mower widths adjacent to a pond, were exposed to a drowning hazard.

29 CFR  1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  (a) On or about August 22, 2022, employees that conduct blade changes and other servicing on lawn mowers, trimmers, and other equipment, were not provided with hazardous energy control procedures that describe the hazardous energy sources (such as, but not limited to; thermal, gravitation, electrical, and kinetic) and the means/methods to isolate and control those hazardous energy sources.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On or about August 22, 2022, employees engaged in lawn servicing and equipment maintenance were exposed to hazardous materials, such as but not limited to; herbicides, gasoline, oils, and lubricants. The employer had not maintain a Hazard Communication/Globally Harmonized System (GHS) program, which would address labeling and other forms of warnings on hazardous material containers, Safety Data Sheets, and employee information and training on the hazards associated with the hazardous materials utilized on site, and is consistent with the GHS (29 CFR 191200(a)(1)).  The written program must also contain the following: 1. A list of all hazardous materials on site; 2. The methods the employer will use to inform employees of the hazards associated with non-routine tasks involving hazardous materials, such as spills; 3. The hazards of the materials contained in piping that is not labeled, and; 4. The method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at the site.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  (a) On or about August 19, 2022, an employee suffered work related injuries when the lawnmower that they were operating flipped upside down into a pond, which resulted in an in-patient hospitalization and the employer did not report the in-patient hospitalization within 24 hours.
