29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about August 19, 2022, at a job site near the intersection of May Avenue and NW 50th Street, in Oklahoma City, OK, an employee was observed working in the trench where the spoil banks were not kept at least 2 feet from the edge of the trench. The employee was exposed to struck by and engulfment hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about August 19, 2022, at a job site near the intersection of May Avenue and NW 50th Street, in Oklahoma City, OK, adequate protective systems such as sloping, benching, or shielding were not used to protect a worker in a trench that was 5 feet or more in depth, from possible collapse of the excavation walls. The employee was exposed to cave-in hazards.
