29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about June 28, 2022, and at times prior thereto, workers were exposed to a fall hazard greater than 6 feet while installing the shingles on the roof of a residential construction site without being tied to an anchor of a personal fall protection system. Miguel Ramirez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1458982, citation number 1, item number 1, and was affirmed as a final order on 3-19-2020, with respect to a workplace located at 4835 USAA Blvd, San Antonio, Texas 78240.
