OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls and crushed by injuries from company vehicles with aerial lift buckets. a) Worksite, 777 Park Ave., Huntington, NY- Employee working in the bucket of a Freightliner Aerial Lift Truck was using the aerial lift to bundle and pull cut branches from trees and lower them to the ground below; on or about 8/23/2022. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in subpart I of this part shall be worn and attached to the boom or basket when working from an aerial lift. a) Worksite, 777 Park Ave., Huntington, NY - Employee working in the bucket of a Freightliner Aerial Lift Truck was not utilizing a personal fall arrest or restraint system while trimming trees approximately 16ft above the ground; on or about 8/23/2022. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
