29 CFR 1926.451(b)(1):Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights is not a fall hazard. On or about August 23, 2022, at a residential construction site at 2306 Cartesian, Katy, TX, employees were exposed to a fall hazard while installing bricks to a wall from a 3-tier scaffold more than 10 feet from the lower level, without the scaffold having full planking on the tier(s) in use. M & J Masonry Construction/ dba Miguel Reyna and/or Jessica Rodriguez was previously cited for a violation of this Occupational Safety and Health Standard 1926.451(b)(1) which was contained in OSHA inspection number 1567208, citation number 1 item number 1a, and was affirmed as a final order on February 28, 2022, with respect to a workplace located at 20930 Blooming Shrubs Ct. in Cypress, TX.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about August 23, 2022, at a residential construction site located at 2306 Cartesian, Katy, TX, employees were exposed to a fall hazard while installing bricks to a wall from a 3-tier scaffold that was more than 10 feet from the lower level, without the use of personal fall arrest system or guardrail system. 29 CFR 1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. On or about August 23, 2022, at a residential construction site at 2306 Cartesian, Katy, TX, employees were exposed to a fall hazard while installing bricks to a wall from a 3-tier scaffold, more than 10 feet from the lower level, without the scaffold having an access ladder for the tier(s) in use.
