29 CFR  1926.451(c)(2)(v):Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.  The employer failed to protect employees from fall hazards. This was most recently documented on or about August 23rd, 2022, in Elkhorn, Nebraska.  Multiple employees were working on a platform that wasn't secured to the forklift.

29 CFR  1926.1052(c)(1)(ii):Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stair rail system along each unprotected side or edge:  The employer failed to protect employees from fall hazards.  This was most recently documented on or about August 23rd, 2022, in Elkhorn, Nebraska 68022.  Multiple employees were using a stairwell that wasn't equipped with a stair rail system.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  The employer failed to protect employees from fall hazards.  This was most recently documented on or about August 23rd, 2022, in Elkhorn, Nebraska.  Multiple employees were observed conducting framing operations at heights greater than 6ft without any form of fall protection.    Domingo Lucas was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1573261 citation number 1, item number 3 and was affirmed as a final order on 03-08-22, with respect to a workplace located at 19813 Cottonwood Street, Gretna, Nebraska 68028.

The employer indicated that he does not have documented proof that he has trained his employees on fall protection requirements in the construction setting.
