29 CFR 1926.651(j)(2):Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) On or about August 24, 2022, at jobsite Regal Ln and Regal Ct in Algonquin, Illinois, employees of Ganziano Sewer and Water Inc. were not protected from materials falling or rolling into a trench while workers were present. A excavator and spoil pile were adjacent to the trench.

29 CFR 1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): a) On or about August 24, 2022 at jobsite Regal Ln and Regal Ct in Algonquin, Illinois, employees of Ganziano Sewer and Water Inc. were not protected from cave-in hazards while working in a trench, measuring approximately 6.9 feet in depth. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
