29 CFR 1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. a) First Class Roofing, on or about August 24, 2022, at the address of 100 W. Main St. Ashland, OH 44805: The employer did not ensure employees were protected from fall hazards while working atop a low sloped commercial structure. Employees installing TPC membrane atop the structure were exposed to falls up to 25 feet to the ground below.

29 CFR 1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. a) First Class Roofing, on or about August 24, 2022, at the address of 100 W. Main St. Ashland, OH 44805: The employer did not ensure employee(s) using fiberglass ladder had their side rails extended at least three feet above the landing surface. Employees were exposed to a fall of 14 feet while using ladder to access/exist the second story roofing from the first floor atop a commercial structure.
