The employer did not ensure the lifting magnet suspended below the hook was equipped with legible markings to indicate the magnet's: 	(1) manufacturer's name and address 	(2) serial number 	(3) lifter weight, if over 100 lbs (45 kg) 	(6) rated load [as described in para. 20-1.2.1(a)] 	(7) ASME BTH-1 Design Category 	(8) ASME BTH-1 Service Class

29 CFR  1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):   On or about October 3, 2022, employees working near and operating the large Caterpillar Forklift, Model Number DP40KL, Serial Number AT19C50586, were exposed to struck-by hazards because the tires were in disrepair and the employer had not removed the forklift from service.

29 CFR  1910.178(q)(6):  Industrial trucks were altered by the addition of extra parts not provided by the manufacturer:   On or about October 3, 2022, employees working near and operating forklifts were exposed to struck-by hazards because the forklifts had been altered:  a. The Yale forklift, Model GLC030BFNUAV084, Serial Number A809NO8872W. was being used with a counterweight that was not provided by the manufacturer.  b. The Caterpillar forklift, Model C5000-LP, Serial Number AT9010666, was being used with front fork extensions that were not provided by the manufacturer.
