29 CFR  1910.1200(e)(1):Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training would be met.  At 101 Industrial Drive, Hermann, Mo 65041 - on August 25, 2022 employees were exposed to hazards associated with chemicals in the workplace due to the employer failing to provide a hazard communication program which described how criteria of this section would be met; specifically labels and other forms of warning, employee information and training would be met.

29 CFR  1910.1200(f)(6)(ii): Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with either:  Product identifier and words, pictures, symbols, or combination thereof, which provided at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information was immediately available to employees under the hazard communication program, did not provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  At 101 Industrial Drive, Hermann, Mo 65041 - on August 25, 2022 employees were exposed to hazards associated with chemical exposures from chemicals transferred and stored into containers which were not marked with product identifier and words, pictures, symbols, or combination thereof, which provided at least general information regarding the hazards of the chemicals.  Specifically employer was transferring 931 Adhesive product and SW 37 universal screen wash to Folgers containers for use in work processes.

29 CFR  1910.1200(h)(1):Employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees had not previously been trained about was introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  At 101 Industrial Drive, Hermann, Mo 65041 - On August 25, 2022 and at times prior thereto employees were exposed to hazards exposed to chemical exposures due to the employer not providing training on hazardous chemicals in their work area at the time of their initial assignment and whenever new chemical hazards were introduced.
