29 CFR  1926.95(d)(1): Except as provided by paragraphs (d)(2) through (d)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employee(s).   Site- Employees voltage testing 480-volt equipment and below were required to purchase their own Class 00 electrical insulating gloves, rated for 500 Volts AC and below, and their accessories.

29 CFR  1926.416(a)(1):Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means:  a. Site- On or about August 24, 2022 an employee was not protected from electric shock and burns where the employer did not deenergize the 480-volt main switch gear where covers were removed and the employee was performing work inside the switch gear. The employee contacted exposed live parts operating at 480-volts and was electrocuted.  b. Site- On or about August 8, 9, and 16, 2022 employees were not protected from electric shock and burns where the employer did not deenergize the 480-volt main switch gear and ASCO transfer switch while performing work inside the equipment.

29 CFR  1926.416(a)(3): Employer did not advise employees of the location of energized electrical power circuits, the hazards involved, and the protective measures to be taken:  a. Site- On or about August 24, 2022 an employee performing work inside the energized 480-volt main switch gear was not protected from electric shock and burns where the employer did not advise the employee on the hazards involved and protective measures to be taken including, but not limited to; deenergizing the 480-volt main switch gear, utilizing the employer's High Voltage Job Site Analysis form,  and implementing the employer's Lockout/Tagout Program. The employee contacted exposed live parts operating at 480-volts and was electrocuted.  b. Site- On or about August 8, 9, and 16, 2022 employees performing work inside the energized 480-volt main switch gear and ASCO transfer switch were not protected from electric shock and burns where the employer did not advise the employee on the hazards involved and protective measures to be taken including, but not limited to; deenergizing the 480-volt equipment, utilizing the employer's High Voltage Job Site Analysis form,  and implementing the employer's Lockout/Tagout Program.

29 CFR  1926.97(c)(2)(viii): Electrical protective equipment was not subjected to periodic electrical tests. Test voltages and the maximum intervals between tests shall be in accordance with Table E-4 and Table E-5.  Site- Electrically insulated gloves that were in service were not subjected to periodic electrical tests according to Table E-5 Rubber Insulating Equipment, Test Intervals.
