29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Fred Diebert dba Precision Roofing and Home Improvements on or about August 24, 2022, at the address of 540 N Wynn Rd, Oregon, OH: The employer did not ensure the employee was protected from falls while working on top of a multi-pitch two-story residential roof with various heights. Employee was assisting with shingles from atop the structure and was exposed to falls of approximately 22ft and greater to the ground below

29 CFR 1926.1053(b)(1):Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) Fred Diebert dba Precision Roofing and Home Improvements on or about August 24, 2022, at the address of 540 N Wynn Rd, Oregon, OH: The employer did not ensure the side rails of one portable aluminum extension ladder was extended at least three feet above the landing surface. During this activity, one employee was exposed to falls up to 12 ft. to the ground below while using the ladder to transition to the roof level.
