29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system: a) On or about 8/19/2022 at a building located at 569 South Park Avenue, Buffalo, New York; employees were installing solar panels on the roof of a two story building. Employees were working from a ladder jack scaffold approximately 18 feet high and were not protected from falling by a personal fall arrest system. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 8/19/2022 at a building located at 569 South Park Avenue, Buffalo, New York; employees were installing solar panels on a steep slope roof of a 2 story building with a fall height of approximately 20 feet. There were no fall protection measures in place. NO ABATEMENT CERTIFICATION REQUIRED
