29 CFR 1926.102(a)(1):29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a) 112 Brimmer Ave - On or about August 26, 2022, the employer did not ensure that eye protective equipment was used when employees were exposed to eye injury while using pneumatic nail guns while shingling the roof. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) 112 Brimmer Ave, New Holland, PA - On or about August 26, 2022, employees were observed working on the roof of a two story house with a pitch of 9x12 on the street face and 9.5x12 on the back side, exposed to fall hazards ranging from 11 to 22 feet, without utilizing an adequate method of fall protection. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) 112 Brimmer Ave, New Holland, PA - On or about August 26, 2022, employees were observed working on the roof of a two story house with a pitch of 9x12 on the street face and 9.5x12 on the back side, two employees used an extension ladder on the first floor backside to access and egress from the roof that was less than a foot above the landing. Two employees used the ladders of a ladder scaffold for access and egress from the front that were less than one foot above the landing, exposing employees to fall hazards of 11 and 22 feet respectively. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
