Conditions such as but not limited to overhead power lines, electrical and fall hazards associated with the removal of the elevated energized advertising sign.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) Route 40 & PGA Blvd Bear, DE 19701(Public Easement): On or about August 25, 2022, employees were exposed to head injury and electrical shock when conducting sign removal work when approved hardhats were not worn. Employees were not wearing head protection and were working in an elevated platform approximately 27 feet above the grade. One employee using the aerial lift controls directed the Versalift-Model-VST-40N, Serial Number #LB180042, Date of Manufacture 04/2018 into one of the three phases of a 12 KV overhead distribution line.

The employer used Google Earth and did not adequately determine the location of energized distribution lines in order to protect employees conducting aerial advertising sign removal or prevent them from exposure.
