29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about August 26, 2022, at the above addressed jobsite, employees using a pneumatic nail gun were not wear safety glasses, thereby exposing the employees to the hazards associated with eye injuries.  N.D.A. Construction, Inc. was previously cited for a violation of this occupational safety and health standard o29 CFR 1926.102(a)(1), which was contained in OSHA inspection  number 1425509, citation number 1, item number 1 and was affirmed as a final order on December 12, 2019, with respect to a workplace located at 3915 Littlestone Circle, Naperville, IL.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a.  On or about August 26, 2022, at the above addressed jobsite, employees performing residential roofing operations, eighteen (18) feet two (2) inches above the ground, were not protected from falls, thereby exposing the employees to fall hazards.  b.  On or about August 26, 2022, at the above addressed jobsite, employees performing residential roofing operations, nine (9) feet above the ground, were not protected from falls, thereby exposing the employees to fall hazards.  c.  On or about  August 26, 2022, at the above addressed jobsite, employees performing residential roofing operations, sixteen (16) feet six (6) inches above the ground, were not protected from falls, thereby exposing the employees to fall hazards.  N.D.A. Construction, Inc. was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1425509, citation number 1, item number 2, and was affirmed as a final order on December 12, 2019, with respect to a workplace located at 3915 Littlestone Circle, Naperville, IL.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a. On or about August 26, 2022, at the above addressed jobsite, employees had been provided fall protection training, however, the employer failed to keep a written certification of record.
