29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and/or were not capable of supporting at least 5,000 pounds (22.2 kN) per employee: a) On or about August 26, 2022, employees performing roofing operations were not protected from fall hazards due to the anchorage system was not independent to each employee tied off. Employees were exposed to falls of approximately eleven (11) feet six (6) inches to twelve (12) feet six (6) inches above the ground. b) On or about August 26, 2022, employees performing roofing operations were using an anchorage system that was damaged and improperly installed/secured; nailed instead of screwed into the roof and was not capable of supporting at least 5,000 pounds (22.2 kN) per employee. Employees were exposed to falls of approximately eleven (11) feet six (6) inches to twelve (12) feet six (6) inches above the ground.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about August 26, 2022, employees performing roofing operations were not protected from fall hazards while working at an elevation of approximately eleven (11) feet six (6) inches to twelve (12) feet six (6) inches above the ground. The Mario's Construction and Roofing, Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1536904, citation number 1, item number 1 and was affirmed as a final order on August 27, 2021, with respect to a workplace located at 7718 161st Street, Tinley Park, IL. 60477.
