OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from attacks by black bears and grizzly bears:   (a) On or about August 25, 2022, and at times prior thereto, employees were exposed to potential attacks from apex predators including captive black bears and grizzly bears while engaged in tasks including, but not limited to, feeding, landscaping, maintenance operations, and Wildlife Excursions.  Abatement Note: Abatement certification AND supporting documentation are required for this item. See enclosed "Certification of Corrective Actions Worksheet."

29 CFR  1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   (a) On or about August 25, 2022, and at times prior thereto, employees are given bear spray to use as a deterrent against bears in case of emergency while they are working in close proximity to them. This condition exposed employees to hazardous chemicals including, but not limited to, capsaicinoids at concentrations formulated to deter bears.  Abatement Note: Abatement certification is required for this item.  See enclosed "Certification of Corrective Actions Worksheet."

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) On or about August 25, 2022, and at times prior thereto, employees are given bear spray to use as a deterrent against bears while they are working in close proximity to them. This condition exposed employees to hazardous chemicals including but not limited to capsaicinoids at concentrations formulated to deter bears.
