29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a. On or about August 30, 2022, the employer failed to ensure the two # 1 angle/bar vertical bending rolls were effectively guarded to prevent employees from the rotational movement of the upper and two lower pinch rolls. b. On or about August 30, 2022, the employer failed to ensure that the #2 angle/bar vertical bending roll was effectively guarded to prevent employees from the rotational movement of the upper and two lower pinch rolls. c. On or about August 30, 2022, the employer failed to ensure that the half angle/bar bending roll was effectively guarded to prevent employees from the rotational movement of the upper and two lower pinch rolls. d. On or about August 30, 2022, the employer failed to ensure that the Upright Buffalo vertical bending roll was effectively guarded to prevent employees from the rotational movement of the upper and two lower pinch rolls.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): On or about August 30, 2022, the employer failed to ensure that effective machine guarding was in place to protect employees from the hazardous area of the Cincinnati press brake #14. The press brake was operated by foot pedal without the use of any other type of additional guarding. Additionally, the rear of the press brake was not effectively guarded and able to be accessed by personnel.
