29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment (PPE). If such hazards were present, or likely to be present, the employer did not: (i) Select, and have each affected employee use, the types of PPE that would protect the affected employee from the hazards identified in the hazard assessment; (ii) Communicate selection decisions to each affected employee; and (iii) Select PPE that properly fit each affected employee: (a) At Dolomite Products Co asphalt plant, on or about 8/30/2022: ARG Trucking Corp had not performed a hazard assessment specific to the process of transferring heated liquid asphalt from an aboveground tank into the top hatch of an ARG trailer and exposed two employees, at separate times, to possible burn hazards. One employee was burned when liquid asphalt splashed back at the employee.
