29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface had not been used. On or about August 30, 2022, ASAP TUCKPOINTING LLC exposed at least three employees to fall hazards. Portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface had not been used to access a scaffold platform.

29 CFR 1926.451(h)(1): In addition to wearing hard hats each employee on a scaffold had not been provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, or guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contained or deflected the falling objects. On or about August 30, 2022, at least two employees of ASAP TUCKPOINTING LLC had not been protected from falling objects, in addition to hard hats. Two employees were exposed to falling object hazards from falling hand tools, materials, debris, and other small objects.
