29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) In the sawmill, an edger operator was exposed to noise levels at 167.9% of the permissible 8-hour TWA (90 dBA). The equivalent dBA level of 167.9% is approximately 93.7 dBA. Sampling was performed for 423 minutes during one shift. Zero exposure was assumed for the unsampled time. (b) In the sawmill, an edger operator assistant was exposed to noise levels at 109.7% of the permissible 8-hour TWA (90 dBA). The equivalent dBA level of 109.7% is approximately 90.6 dBA. Sampling was performed for 318 minutes during one shift. Zero exposure was assumed for the unsampled time. (c) In the sawmill, a chop saw operator was exposed to noise levels at 94.80% of the permissible 8-hour TWA (90 dBA). The equivalent dBA level of 94.80% is approximately 89.6 dBA. Sampling was performed for 411 minutes during one shift. Zero exposure was assumed for the unsampled time. (i) In the sawmill, a chop saw operator was exposed to noise levels at 84.28% of the permissible 8-hour TWA (90 dBA). The equivalent dBA level of 84.28% is approximately 88.7 dBA. Sampling was performed for 418 minutes during one shift. Zero exposure was assumed for the unsampled time.
