29 CFR  1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  On or about August 29, 2022, at the KB Utilities site, the employer did not instruct each employee to recognize and avoid the unsafe conditions presented by the retention pond that was utilized by the employees, to control or eliminate any hazards or other exposure to injury or illness.

29 CFR  1926.106(a):Employees working over or near water, where the danger of drowning exists, shall be provided with U.S. Coast Guard-approved life jacket or buoyant work vests.  On or about August 29, 2022, the employer did not provided employees with U.S. Coast Guard-approved life jacket or buoyant work vests while working at the retention pond.
