OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible chemical dust.   a) On or about August 12, 2022, in the Building B at Continental Warehouse facility, located in Alvin, TX, employees were exposed to combustible chemical dust hazards, when the employer failed to ensure the dust collection system was connected and operational during the processing of powder chemicals in the blender/mixer.

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by Guard rail systems, safety net systems or Personal fall arrest system.  On or about August 12, 2022, in the building B at Continental Warehouse facility located in Alvin, TX, the employer did not protect employees from a fifteen (15) foot fall hazard when guard rail systems were not installed on all sides of the mixer/blender machine.
