29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) Continental Milling, Inc. at I-225 and Chambers Road in Aurora, CO: On or about August 31, 2022, and at times prior, employees were exposed to physiological and respiratory hazards when voluntarily wearing tight-fitting half-face respirators when engaged in milling on concrete and asphalt roads. The employer did not provide medical evaluations to ensure employees were medically able to wear respirators.
