29 CFR  1910.134(c)(2)(i): The employer has not provided respirator users with the information contained in Appendix D to this section for voluntary use of a respirator.   a) Ross Industrial, LLC, 104 North Maple Avenue, Leola PA 17540 - On or about August 31, 2022, the employer had not provided employees with the information contained in 29 CFR 1910.134 Appendix D before allowing the employee to voluntary wear the 3M 6300 half face respirator.  b) Ross Industrial, LLC, 104 North Maple Avenue, Leola PA 17540 - On or about August 31, 2022, the employer had not provided employees with the information contained in 29 CFR 1910.134 Appendix D before allowing the employee to voluntarily wear the 3M Particulate Filter P95 respirator.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR  1910.134(c)(2)(ii): The employer did not implement a written respiratory protection program to ensure employees using a respirator voluntarily are medically able to use the respirator and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user.  a) Ross Industrial, LLC, 104 North Maple Avenue, Leola PA 17540 - On or about August 31, 2022, the employer allowed employees to wear the 3M 6300 half face respirator voluntarily but had not developed a written respiratory protection program that ensured employees using the respirator voluntarily were medically able to use the respirator and that respirators were stored in a clean environment.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
