29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a) Roof - The employer did not have a competent person on the job site in that none of the employees who worked on the site on September 1, 2022 inspected the job site, identified predictable fall and struck-by hazards, and took immediate actions to correct the hazards.  Employees did residential roofing work on a two-story single-family home without using fall protection and did not wear eye protection when using or working near other employees using pneumatic nail guns, exposing employees to the struck by and fall hazard.   No abatement certification or documentation required.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) Roof - Employees used pneumatic nail guns to install new roofing materials, including new shingles, and the employer did not ensure that each employee wore eye protection, exposing the employees to a struck-by hazard from ricocheting nails, on or about September 1, 2022.  No abatement certification or documentation required.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  (a) Roof - Employees did roofing work, including installing new shingles, on the two-story single-family home.  The employees did not use guardrail systems, safety net systems, or personal fall arrest systems for fall protection nor did they use an alternative fall protection measure, exposing the employees to the hazard of falling from the roof to the ground below, on or about September 1, 2022.  No abatement certification or documentation required.
