29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a) Roof - The employer did not have a competent person on the job site in that none of the employees who worked on the site on September 1, 2022 inspected the job site, identified predictable fall and struck-by hazards, and took immediate actions to correct the hazards. Employees did residential roofing work on a two-story single-family home without using fall protection and did not wear eye protection when using or working near other employees using pneumatic nail guns, exposing employees to the struck by and fall hazard. No abatement certification or documentation required.
