29 CFR 1926.651(l): Walkways shall be provided where employees or equipment are required or permitted to cross over excavations. Guardrails which comply with 1926.502(b) shall be provided where walkways are 6 feet (1.8 m) or more above lower levels. (a) On or about August 30, 2022, at the worksite located at S. Moorland Rd. and W. Coffee Rd., the employer did not ensure an adequate walkway was provided to span the gap between where the ladder was placed on top of the trench box and the existing roadway. An open space measuring approximately 2 feet existed between the vertical wall of the excavation and the top of the trench shield where the ladder was placed for access, thereby exposing workers to potential fall hazards.

29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) On or about August 30, 2022, at the worksite located at S. Moorland Rd. and W. Coffee Rd., the employer did not ensure adequate trench protection was utilized. A piece of plywood sheathing measuring approximately 3/4" thick was used on the eastern side of the excavation in order to provide trench protection, thereby exposing workers to struck-by hazards.

29 CFR 1926.652(g)(1)(ii): Shields were not installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads: (a) On or about August 30, 2022, at the worksite located at S. Moorland Rd. and W. Coffee Rd., the employer did not ensure a trench shield was installed where lateral or other hazardous movement would be restricted. A trench shield was installed where the open space between the trench shield and vertical wall of the excavation measured between approximately 2 feet and 3 feet, 5 inches, thereby exposing workers to struck-by hazards.
