29 CFR  1910.176(a):Where mechanical handling equipment was used, sufficient safe clearances were not allowed for aisles, at loading docks, through doorways or wherever turns or passage had to be made:  a. The Cold Storage Area - On or about August 30, 2022, the employees access the building near the breakroom where forklift traffic enters and exits the building without markings or sufficient safe clearances, exposing employees to a struck by hazard.  b. The Cold Storage Area - On or about August 30, 2022, an employee was struck by a forklift while passing an area in front of the entry and exit doors from the building. The area was not marked to prevent or deter pedestrian traffic exposing employees to a struck by hazard.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1904.7(b)(3): The employer did not correctly classify the following work-related injuries or illnesses on the OSHA Form 300 or equivalent.    a. Peach Glen Facility - On or about August 30, 2022, the employer had failed to properly classify 300 Log case PG-10 as a lost time case by selecting to classify it under column (J) other recordable cases despite the employee having had a single loss workday and 8 days of job restriction/transfer.  corrected during inspection

29 CFR  1904.29(b)(1): The employer did not enter a one or two line description for each recordable injury or illness in column (F) of the OSHA 300 form or equivalent.   a. Peach Glen Facility - On or about August 30, 2022, case PG-6, the employer had failed to describe what caused the injury in column (f) of the OSHA 300 form.   b. Peach Glen Facility - On or about August 30, 2022, case PG-7, the employer had failed to describe what caused the injury in column (f) of the OSHA 300 form.  c. Peach Glen Facility - On or about August 30, 2022, case PG-8, the employer had failed to describe what caused the injury in column (f) of the OSHA 300 form.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
