29 CFR  1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) 177 Passaic Ave, Belleville, NJ 07109  Employer did not establish and implement a written respirator protection program for employees required to use 3M N95s and 3M 7502 Half-face respirator.  Employees wearing respirators worked with Spies Hecker paint, primers, and hardeners and SEM adhesives, plastic repair materials, and sealers.  Violation observed on or about 09/01/2022.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) 177 Passaic Ave., Belleville, NJ 07109  The employer did not provide medical evaluations for employees who are required to wear 7502 3M half face respirators in the spray booth side room while mixing paints and 3M N95s in the autobody shop. Employees wearing respirators worked with Spies Hecker paint, primers, and hardeners and SEM adhesives, plastic repair materials, and sealers.  Violation occurred on or about 09/01/2022.

29 CFR  1910.134(f)(2): Employer did not ensure that an employee using a tight-fitting facepiece respirator was fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) was used, and at least annually thereafter:  a) 177 Passaic Ave., Belleville, NJ 07109  The employer did not ensure employees who are required to wear 7502 3M half face respirators in the spray booth side room while mixing paints and 3M N95 respirators in the autobody shop at all times were not fit tested prior to initial use of the respirators. Employees wearing respirators worked with Spies Hecker paint, primers, and hardeners and SEM adhesives, plastic repair materials, and sealers.  Violation occurred on or about 09/01/2022.
