29 CFR 1926.850(a): Evidence in writing was not available that an engineering survey performed by a competent person had been performed prior to permitting employee(s) to start demolition operations:  (a) Steel Valley Contactors, LLC, on or about September 7th, 2022, at the location of 253 Arlington St., Youngstown, OH, 44502: The employer did not have evidence in writing that an engineering survey was performed by a competent person. Employees were working in the area of the potential fall or collapse of a partially demolished parking garage and exposed to potential crush and struck by injuries.

29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  (a) Steel Valley Contactors, LLC, on or about September 7th, 2022, at the location of 253 Arlington St., Youngstown, OH, 44502: Employees were utilizing heavy equipment and utility vehicles during demolition activities involving silica-containing materials without implementing the appropriate controls specified in table 1 without an exposure assessment.

29 CFR  1926.1153(d)(2)(i):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  (a) Steel Valley Contactors, LLC, on or about September 7th, 2022, at the location of 253 Arlington St., Youngstown, OH, 44502: Employees were engaged in a table 1 activity but did not implement the required engineering controls. The employer did not conduct an assessment of the employee exposure to respirable crystalline silica.
