29 CFR  1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person performing the training or evaluation:  (a)Manny's Roofing at 7001 West 56th Street, Sioux Falls, SD 57106:  On or about and at times prior to September 7, 2022, the employer did not ensure employees were protected from stuck-by hazards in that, not all forklift operators were trained, evaluated and certified by the employer prior to operating forklifts on site.  This condition exposed employees to struck-by hazards associated with improper forklift usage.

This condition exposed employees to fall hazards greater than six feet.

The program did not enable each employee to recognize the hazards of falling and did not train each employee in the procedures to be followed in order to minimize these hazards:  (a)Manny's Roofing at 7001 West 56th Street, Sioux Falls, SD 57106:  On or about and at times prior to September 7, 2022, the employer did not ensure that employees were properly trained on the use of fall protection systems prior to being exposed to fall hazards while working on a residential roof.  This condition exposed employees to fall hazards greater than six feet.
