29 CFR  1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:   a)Worksite, 1502 Curry Road, Rotterdam, NY -  On September7, 2022, and at times prior, employees were working from a fabricated frame scaffold approximately 12-feet above the ground that had not been inspected by a competent person for visible defects, defect was no guardrails were installed along the top of the second tier.

29 CFR  1926.451(g)(1)(vi):Each employee performing overhand bricklaying operations from a supported scaffold shall be protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).  a) Worksite, 1502 Curry Road, Rotterdam NY: On September 7, 2022, and at times prior, employees were laying masonry block on the 2nd-tier of the fabricated frame scaffold approximately 12-feet above the ground and did not have fall protection.   J.C. McCashion was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1)(vii), which was contained in OSHA inspection number 1345766, citation number 1, item number 1 and was affirmed as a final order on November 9, 2018, with respect to a workplace located at 1651 Western Ave, Albany, NY 12203.
