29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment:   a) At the facility: On or about September 6, 2022, the employer did not provide a hearing conservation program for an employee who was exposed to a time weighted average (TWA) of 87.3 decibels on the A scale (dBA) or an equivalent dose of 69.18% for a run time of 421 minutes, which exceeded the permissible exposure level of 85 dBA and thus exposed the employee to the hazards associated with hearing loss.

Guards may be hinged or otherwise arranged to permit oiling and the removal of saws:   a) In the mill area: on or about and at times prior to August 25, 2022, the employer exposed employees to amputation and caught-in hazards in that employees who performed housekeeping activities around the edger were not protected by guards.  b) In the mill area, at the edger: on or about and at times prior to September 6, 2022, the employer exposed employees to amputation hazards in that the sprocket and gears of the conveyor feeding the edger were not guarded for employees who cleaned the area.
