OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards. On or about August 20, 2022, and at times prior thereto, wheel loader operators were handling unstable loads with a fork attachment in and around the salvage yard, exposing employees to a struck-by hazard.

Damaged or defective slings were not immediately removed from service. On or about August 20,2022, at approximately 7:07AM, an employee suffered an injury that resulted in a hospitalization. The hospitalization was not reported within 24 hours to the local Area Offices of the Occupational Safety and Health Administration.
