29 CFR 1926.501(a)(2):The employer did not determine if the working/walking surfaces on which its employees were to work had the strength and structural integrity to support the employees safely: a) Jobsite: On September 06, 2022, two employees were elevated with a JLG SkyTrak Telehandler equipped with a Haugen work platform for the purpose to deliver/unload insulation product to the roof. Employees exited the work platform which was positioned approximately 2-inches above the 6-foot parapet wall and climbed down the 6-foot parapet wall and/or jumped off the work platform. An employee broke through the plywood decking and struck the concrete floor below. The employer's designated representative permitted employees to exit the elevated platform for which no determination was made as to its structural integrity.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: a) On September 06, 2022, the employer did not ensure that two employees elevated with a JLG SkyTrak Telehandler equipped with a Haugen work platform for the purpose to deliver/unload insulation product to the roof were exposed to fall hazards up to 22 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) On or about September 06, 2022, and at times prior thereto, employees delivering insulation product to a roof structure were unable to recognize the hazards of falling and were not equipped with knowledge in the procedures to be followed in order to minimize the risk. Employees were exposed to fall hazards ranging from 6-feet up to 22.5-feet.
