29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  On or about 09/09/2022, on site of a residential structure under construction located at 241 Osprey Preserve Boulevard in Jensen Beach, Florida, an employee performing stucco preparation work was exposed to a 21-foot fall hazard prior to the employer performing an inspection of the site to ensure all required safety equipment was available and being used prior to commencing work.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  On or about 09/09/2022, on the south exterior elevation of a residential structure under construction located at 241 Osprey Preserve Boulevard in Jensen Beach, Florida, an employee was exposed to a fall hazard of approximately 21 feet when performing stucco preparation work from the basket of an aerial lift while not wearing a safety harness with a lanyard attached to the anchor point provided on the lift.

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  On or about 09/09/2022, on site of a residential structure under construction located at 241 Osprey Preserve Boulevard in Jensen Beach, Florida, an employee was exposed to a fall hazard when performing stucco preparation work from the basket of an aerial lift prior to being provided with training that would enable him to recognize the hazards associated with falling while using the lift.

29 CFR 1926.453(b)(2)(ix): Controls for the articulating and extensible boom platforms were not clearly marked to identify their function:    On or about May 23, 2019, on the south exterior elevation of an commercial building under construction located at 6820 S. Kanner Highway in Stuart, Florida, employees were exposed to a fall hazard when operating an aerial lifts to perform stuccowork while the control panels of the lifts were covered with stucco material and the controls were not visible and/or plainly marked as to their function.
