29 CFR  1926.453(b)(2)(v):A fall arrest system shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  a) Building 400, Autumn Park Blvd., Medford, NJ: on or about September 9, 2022 two Gotham Exteriors LLC employees were working in the basket of a SJ66T Skyjack telescopic articulating boom lift. One employee had a harness on but was not anchored to the lift via tie off point and the other employee had no harness and were not anchored to the lift exposing them to potential fall hazards. They were installing shutters on the third floor area of the structure.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
