1910.178(n)(4)  The driver shall be required to slow down and sound the horn at cross aisles and other locations where vision is obstructed. If the load being carried obstructs forward view, the driver shall be required to travel with the load trailing. 29 CFR 1910.178(l)(4)(ii):Refresher training in relevant topics shall be provided to the operator when: (A) The operator has been observed to operate the vehicle in an unsafe manner; (B) The operator has been involved in an accident or near-miss incident.  On or about September 21, 2022, the employer did not provide refresher trainer for 29 reported incidents of forklift operators who were observed operating forklifts in an unsafe manner and who were involved in near misses and accidents. Theses included but are not limited to not sounding the horn when at blind areas and driving too fast.  a) On or about May 5, 2022 in operations, a forklift operator did not sound their horn when approach blind spots, resulting in near miss when a pedestrian stepping into the aisle.  b) On or about May 6, 2022 in operations, a forklift operator was driving around the corner too quickly and without sounding their horn, exposing employees to struck by hazards.  c) On or about May 10, 2022 in transportation and logistics, an employee, who was working in the roll stock area, was nearly hit by a forklift operator who did not sound their horn.
