29 CFR 1926.453(b)(2)(v):A body belt (harness) and lanyard was not attached to the boom or basket when working from an aerial lift: a) On or about 09/09/2022, while in the process of painting upper levels of the exterior of the NAPA Auto Parts Store, located at 4630 Lake Road, in Brockport, New York, the employer did not enforce the use of fall protection to employees working in the basket of an aerial boom lift, 14 feet above lower levels. Employees were allowed to work in an articulating boom without the proper use of Personal Fall Arrest Systems such as "tying off" to the boom basket with a lanyard. NO ABATEMENT CERTIFICATION REQUIRED
