29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and/or were not capable of supporting at least 5,000 pounds (22.2 kN) per employee: (a)Ochoa General Contractors, LLC at 3408 West Ralph Rogers Road, Sioux Falls, SD 57108: On or about and at times prior to September 14, 2022, the exposing employer did not ensure employees were protected from fall hazards when performing roofing work on a three story residential property, in that multiple personal fall protection systems utilized one Guardian Temper Anchor (Part #: 00455) as an anchor point. Abatement Note: Guardian Instructional Manual states Temper Anchor may be used to support a MAXIMUM of one personal fall arrest system for the use of fall arrest applications. This condition exposed employees to fall hazards greater than six feet.

29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head: (a)Ochoa General Contractors, LLC at 3408 West Ralph Rogers Road, Sioux Falls, SD 57108: On or about and at times prior to September 14, 2022, the exposing employer did not ensure employees were protected from fall hazards when performing roofing work on a three story residential property by use of an appropriate attachment of the body harness. Employees were observed attaching rope grab lanyards to the front straps of body harnesses. This condition exposed employees to fall hazards greater than six feet. (b)Ochoa General Contractors, LLC at 3408 West Ralph Rogers Road, Sioux Falls, SD 57108: On or about and at times prior to September 14, 2022, the exposing employer did not ensure employees were protected from fall hazards when performing roofing work on a three story building by use of an appropriate attachment of the body harness. Employees were observed with the attachment point of the body harness below shoulder level of the wearers back. This condition exposed employees to fall hazards greater than six feet.
