The Chef's Garden, Inc. - Huron, Ohio: On or about August 2, 2022, the employer did not ensure that the International Harvester 274 tractor (s/n 2130007J008231) was equipped with a roll-over protective structure (ROPS) to protect the operator from crushing injuries in the event the tractor overturns. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1928.51(d): Every employee who operates an agricultural tractor was not informed of operating practices contained in Appendix A of this part and of any other practices dictated by the work environment. a. The Chef's Garden, Inc. - Huron, Ohio: On or about August 3, 2022, the employer did not ensure that employees who operated the International Harvester 274 tractor (s/n 2130007J008231) received annual training in safe operating procedures. An employee(s), preparing to adjust the tractor's implement, was exposed to being run over by the tractor in that the parking brake was not set and transmission put into neutral prior to dismounting, and the engine was not started from the seat of the tractor. Appendix A to Subpart C of Part 1928 - Employee Operating Instructions: 1. Securely fasten your seat belt if the tractor has a ROPS. 2. Where possible, avoid operating the tractor near ditches, embankments, and holes. 3. Reduce speed when turning, crossing slopes, and on rough, slick, or muddy surfaces. 4. Stay off slopes too steep for safe operation. 5. Watch where you are going, especially at row ends, on roads, and around trees. 6. Do not permit others to ride. 7. Operate the tractor smoothly - no jerky turns, starts, or stops. 8. Hitch only to the drawbar and hitch points recommended by tractor manufacturers. 9. When tractor is stopped, set brakes securely and use park lock if available. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
