OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard.   On or about September 13, 2022, an employee was standing on the forks of an unattended JLG SkyTrak telehandler that was parked on an incline while repairing a louver window without the wheels being blocked, exposing employees to a struck-by hazard.

29 CFR 1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that is reasonably accessible in terms of time and distance to the worksite, which is available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, was not available at the worksite to render first aid:  On or about September 13, 2022, the employer did not ensure that someone had a valid certificate in first-aid training or equivalent to provide medical services, exposing employees to the hazards associated with delayed medical treatment.

On or about September 13, 2022, an employee was working from a scaffold platform that was not attached to the lifting carriage or forks of a JLG SkyTrak telehandler, exposing the employee to the hazard of falling approximately 11 feet to the ground below.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  A. On or about September 13, 2022, an employee used a Stihl TS 420 saw to cut the inside of a louver window while working from two 1-inch by 12-inch wooden boards placed across the louver window and internal wall of a wastewater treatment plant without fall protection, exposing the employee to a fall hazard of approximately 11 feet 5 inches to the ground below.  B. On or about September 13, 2022, an employee used a Stihl TS 420 saw to cut the outside of a louver window while working from a platform placed onto the forks of a JLG SkyTrak telehandler without fall protection, exposing the employee to a fall hazard of approximately 11 feet 5 inches to the ground below.

On or about September 13, 2022, an OSHA Form 301 or equivalent for work-related injuries or illnesses was not filled out or incorrectly filled for the calendar year 2022. For eighteen of the twenty OSHA 301 cases, the employer did not include emergency room treatment, overnight hospitalization, and case number from the log.
