OSH ACT of 1970 Section 5(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by wood building components in the event of structural collapse:  (a) Garage section of newly constructed building; On or about September 7, 2022, adequate bracing/restraint was not provided for the trusses and walls of the newly constructed 112 foot long by 80 foot wide garage area of a building while framers installed 80 foot long metal plate connected wood trusses atop 16 foot tall wooden framed walls.  The workers were exposed to the hazards of being struck by building components while rigging trusses, installing trusses and when the previously set trusses and walls (north and southeast) collapsed during truss setting and bracing operations.  (b) Rigging area and Garage section of newly constructed building; On or about September 7, 2022, a 30 foot long spreader bar used to lift and place 80 foot long trusses (long-span trusses) was not attached to the truss at least every 10 feet and was not at least 2/3 to 3/4 of the truss length to prevent lateral bending of the truss during handling and installation operations.

29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) Garage section of newly constructed building; Prior to installing long-span trusses on or about September 7, 2022, employees were not trained in the BSCI requirements for installing diagonal truss bracing to stabilize continuous lateral bracing on the top chord, bottom chord, and web locations.  (b) Garage section of newly constructed building; Prior to installing long-span trusses on or about September 7, 2022, employees were not trained in the BSCI requirements, which prohibit the use of metal truss spacers as lateral bracing.  Metal truss spacers were used as continuous lateral bracing instead of wooden 2"x4" lateral bracing at three locations on the top truss chord.

29 CFR 1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) Garage section of newly constructed building; On or about September 7, 2022, hardhats (protective helmets) were not worn by employees who were exposed to overhead hazards of tools and materials striking and/or falling on their head during truss setting operations.

29 CFR 1926.453(b)(2)(v):  A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e):  (a) On or about September 7, 2022, a means of fall restraint or fall protection system was not worn while performing work from a JLG brand aerial lift during truss setting operations.
