On or about September 14, 2022, at the above addressed jobsite, employees conducting sewer repair operations undermined the pavement/ sidewalk, thereby exposing employees to struck-by hazards.

On or about September 14, 2022, at the above addressed jobsite, the employer failed to ensure a competent person removed employees from and excavation after recognizing hazardous conditions thaat exposed employees to potential cave-in hazards.

29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a. On or about September 14, 2022, at the above addressed jobsite, an employee working in a trench was not wearing a hard hat to protect against falling materials and debris.  Tarmonbarry, LLC dba Keenan Sewer & Water was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.100(a), which was contained in OSHA inspection number 1295471, citation number 1, item number 2 and was affirmed as a final order on June 13, 2018, with respect to a workplace located at 1433 N Wells Street, Chicago, IL 60610.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a. On or about September 14, 2022, at the above addressed jobsite, employees were conducting sewer repair operations in a trench measured at seven (7) feet in depth.  The trench was not provided with adequate cave in protection, thereby exposing the employees to cave in hazards.  Tarmonbarry, LLC dba Keenan Sewer & Water was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.652(a)(1), which was contained in OSHA inspection number 1295471, citation number 1, item number 4 and was affirmed as a final order on June 13, 2018, with respect to a workplace located at 1433 N Wells Street, Chicago, IL 60610.
