Section 5(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:    a) On or about September 15, 2022,  at the construction site located on the corner of Lennox Drive & Baltimore Drive in Bismarck, ND employees were exposed to fall hazards while being elevated by and riding on the forks of an all terrain forklift model SkyTrak 8042 to gain access the roof of a house under construction.  Among other methods, feasible and acceptable methods of abatement are but not limited to:  1)  Ensure that all employees of the company follow both the manufacturers recommendations in the operators manual and follow the ASME/ANSI B56.6 2011 Safety Standard for Rough Terrain Forklift Trucks.    2)  Ensure that employees are provided with adequate means for accessing the exterior portions of the home such as but not limited to an extension ladder, aerial lift, approved work platform used in accordance with the forklift manufacturer's instructions.  3)  Ensure that all employees involved in the operation are trained and briefed prior to working with this equipment of the hazards involving elevating employees and stability issues involving this piece of equipment.

29 CFR  1926.34(c): Means of egress was not continually maintained free of all obstructions or impediments to full instant use in the case of fire or other emergency:  a) On or about September 15, 2022 at the construction site located at the corner of Lennox Drive & Baltimore Drive in Bismarck, ND, employees were not provided means of egress from upper levels of the building. Employees were required to climb down through the rafters to gain access to a step ladder placed below the upper levels.

29 CFR  1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:   a) On or about September 15, 2022 at the construction site located on the corner of Lennox Drive & Baltimore Drive in Bismarck, ND employees were exposed to fall hazards of 20 feet when step ladders were used by employees to ascend or descent from an elevated walking working surface, did not have rails that extended three feet above the upper landing surface.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) On or about September 15, 2022 at the construction site located on the corner of Lennox Drive & Baltimore Drive in Bismarck, ND,  employees were exposed to fall hazards of 20 feet from upper levels of the structure while installing sheetrock for a fire wall. The employer failed to ensure that the proper fall protection was being used.  Note: This company was previously cited for a violation of this Occupational Safety and Health Standard, or its equivalent standard, which was contained in OSHA inspection number 1484057, citation number 1, item 1, and was affirmed as a final order on October 13, 2020, with respect to a workplace located near the intersection Of Monreo Drive & Del Rio Drive, in Bismarck, North Dakota.
