29 CFR 1926.1053(b)(16):Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired. On or about September 15, 2022 at a jobsite located at 100 Great Loop Dr. #33 and 34, Ottawa, IL 61350 a Werner extension ladder was installed and being used to access the upper level of a new residential construction duplex. The Werner extension ladder has visible defects affecting the safe use.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On or about September 15, 2022 at jobsite located at 100 Great Loop Dr., #32 and 34, Ottawa, IL 61350. Employees were exposed to fall hazards in excess of 10 feet while engaged in framing of a residential new construction dwelling. While engaged in the frame work employees were observed traveling from #32 to #34 and returning via the elevated landings. The landings lacked any guard rail system and the employees were not utilizing any fall protection systems. L A Brooker Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1507389, citation number 1, item number 1 and was affirmed as a final order on March 2, 2021 with respect to a workplace located at 186 Sunset Ave., Glen Ellyn, IL 60137. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.503(b)(1):The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training. On or about September 15, 2022, the employer did not have, and employees were not provided with documentation of training provided to them for fall protection. The employees showed knowledge of fall protection training. The employer has trained the employees informally. Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
