29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  On or about 09/16/2022, the employer did not maintain jobsite inspections that were performed by a person competent to ensure employees were not exposed to the hazard of falling during construction operations.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  On or about 09/16/2022, the employer did not ensure appropriate fall protection was implemented for employees performing commercial roofing operations on a flat roof that was greater than 50 feet wide.  The employees were exposed to fall hazards of approximately thirteen (13) feet.

29 CFR 1926.502(f)(1)(i): When no mechanical equipment was being used the warning line was not erected at least 6 feet (1.8m) from the roof edge:    On or about 09/16/2022, the employer did not ensure that the warning line was installed at least six (6) feet from the edge when employees were performing commercial roofing operations.  Employees were exposed to the hazard of falling approximately thirteen (13) feet when a warning line that was installed approximately twenty-four inches from the edge of the roof.

29 CFR 1926.502(f)(2)(ii): The rope, wire, or chain was not rigged or supported in such a way that its lowest point (including sag) was not less than 34 inches (0.9 m) from the walking/working surface and its highest point no more than 39 inches (1.0 m) from the walking/working surface.   On or about 09/16/2022, the employer did not ensure that the warning line was erected so its lowest point was not less than 39 inches from the walking/working surface of the roof.  The warning line installed on the back side of the roof had caution tape that was sagging so it was touching the ground.
