29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) Worksite, 9 James Street, Waterford, New York: On or about September 16, 2022, an employee was operating a pneumatic nail gun on the roof of a residential building without the use of eye protection.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Worksite, 9 James Street, Waterford, New York, front of house: On or about September 16, 2022, an employee was using an extension ladder to access a second floor roof, approximately 20 feet above the ground. The side rails of the ladder extended approximately 16 inches above the landing surface.  b) Worksite, 9 James Street, Waterford, New York, back of house: On or about September 16, 2022, an employee was using an extension ladder to access a first floor roof, approximately 10 feet above the ground. The side rails of the ladder extended approximately 16 inches above the landing surface.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Worksite, 9 James Street, Waterford, New York: On or about September 16, 2022, an employee was conducting roofing work on the roof of a residential building, approximately 20 feet above the ground and did not have fall protection.  United Home Renovations Inc  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1531214, citation number 1,  item number 1 and was affirmed as a final order on March 31, 2022, with respect to a workplace located in Gloversville, New York.
